1. Definitions

• Platform / Loqaly: The online platform, mobile application, and related services operated by OneAM Productions.
• User: Any individual or entity using the Platform, including customers and merchants.
• Merchant: A store, vendor, or business listing their products or services through Loqaly.
• Customer: Any user browsing, interacting with, or purchasing from merchants through Loqaly.

2. Purpose of the Platform

Loqaly is a digital platform that connects customers with local merchants. We act solely as an intermediary to facilitate communication, discovery, and transactions between users and merchants. We are not a manufacturer, retailer, delivery company, or seller of any product or service listed by merchants.

All products, services, pricing, availability, and quality are the sole responsibility of the respective merchants.

3. Acceptance of Terms

By creating an account or using any feature of Loqaly, you confirm that you have read, understood, and agree to these Terms. We may update these Terms periodically, and continued use of Loqaly implies your acceptance of the updated version.

4. User Responsibilities

• You must provide accurate, current, and complete information when creating or updating your account.
• You are responsible for all activity occurring under your account credentials.
• You must comply with all applicable laws and regulations while using the Platform.
• You shall not use Loqaly for any illegal, fraudulent, or unauthorized activities.

5. Prohibited Conduct

Users are strictly prohibited from engaging in any of the following actions:

• Attempting to reverse engineer, decompile, or modify the Loqaly app, website, or any of its source code.
• Distributing malware, exploiting vulnerabilities, or interfering with platform operations.
• Engaging in abusive, offensive, or harassing behavior toward other users, merchants, or Loqaly staff.
• Using the platform for money laundering, scams, or illegal trade.
• Uploading false listings, fake reviews, or misleading content.
• Accessing, collecting, or storing user data without authorization.

6. Platform Integrity

We reserve the right to suspend, terminate, or restrict access to any account found to be violating these Terms, engaging in suspicious activity, or harming the Platform’s reputation or operations.

7. Content & Intellectual Property

All text, design, graphics, logos, code, and other content on Loqaly are the property of OneAM Productions or its licensors. You are granted a limited, non-exclusive, non-transferable right to use Loqaly for personal purposes only. Any unauthorized use, copying, or modification is prohibited.

8. Role of Loqaly

Loqaly acts only as a platform facilitator. We do not own, sell, produce, or deliver the goods/services listed by merchants. All dealings, quality issues, pricing disputes, or claims are between the customer and the merchant.

• Loqaly does not guarantee the accuracy, safety, legality, or quality of any listings.
• We are not responsible for delays, product defects, expired goods, or misrepresentation by merchants.
• Merchants are fully responsible for complying with all legal, tax, and business regulations applicable to their operations.

9. Limitation of Liability

To the maximum extent permitted by law, OneAM Productions shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use Loqaly. Our total liability, in any case, shall not exceed the amount paid by the user for the specific transaction in question, if applicable.

10. Illegal or Unauthorized Activity

Any illegal activities carried out by users or merchants — including fraud, sale of prohibited goods, or any violation of local law — are their own responsibility. Loqaly shall not be held liable for such actions and will cooperate with law enforcement as required.

11. Account Termination

We may suspend or permanently terminate accounts for violations of these Terms, fraudulent transactions, or misuse of the Platform. Termination does not waive any right to claim damages or recover losses incurred due to such violations.

12. Privacy & Data Usage

Your personal information is collected and processed according to our Privacy Policy. By using Loqaly, you consent to such data handling for the purposes of account management, communication, and order facilitation.

13. Third-Party Services

Loqaly may integrate third-party APIs or services (like payment gateways, maps, or delivery providers). We are not responsible for failures, breaches, or issues arising from those third-party services.

14. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We make no guarantees about uninterrupted service, data accuracy, or error-free functionality. Use of Loqaly is at your own risk.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed under the laws of India. All disputes shall fall under the exclusive jurisdiction of the courts located in Patna, Bihar.

16. Modifications

We may modify these Terms at any time, and changes will be effective once posted on the Platform. Continued use of Loqaly after such updates constitutes acceptance of the revised Terms.
